1. Introduction

This policy governs the use of your personal information by Polylude Limited, its related bodies corporate, employees, contractors, managers, officers and directors (collectively, “Polylude”, “we”, “us”, and “our”).

Polylude respects the privacy of all Personal Information it holds and is committed to protecting and limiting the use of such information. While holding, processing or otherwise collecting Personal Information in New Zealand, we will do so in accordance with the Information Privacy Principles as provided in the Privacy Act 2020 (Privacy Act).

2. Acceptance of this privacy policy

You accept this Privacy Policy, and authorise the collection, use, disclosure, storage and retention of your personal information by Polylude as described in this Privacy Policy when you become or enquire about becoming a member, access, browse, view or use our websites (Site), or otherwise provide us with any of your personal information.

Polylude reserves the right to update this Privacy Policy at any time with changes coming into effect when the Privacy Policy is posted to any of its websites, unless any of the amendments are substantial, in which case we will provide you with 2 weeks notice by emailing you.

3. Personal information

“Personal Information” means any information relating to an identifiable individual. The types of personal information we collect include:

  • your name;
  • your postal address;
  • your country of residence;
  • your language preference;
  • your public account profile information;
  • your email address;
  • information about any communications between you and Polylude;
  • your telephone number(s); and
  • payment information including credit card details and billing information.

We also collect Information which does not allow us to identify you specifically, including:

  • your computer’s IP address;
  • your device type;
  • browser type;
  • preferred languages;
  • details of the site from where you accessed our Site;
  • Concepts, links, and their contents. These ‘contents’ may be their displayed text or their associated properties — either explicit in the form of name-value pairs, or implicit including their canvas position, history, or revision index. These contents are usually communicated at the time of saving or publication, but sometimes partial collection may occur to provide richer context for the entered information.
  • “Series”, including their name, their listing index, the concepts and links they contain, and how you order those contents.
  • “Playpens”, with the series, concepts, links — and concept or link references — they contain. And how you configure playpens, including their name, privacy, and last-updated status.
  • the pages you visit on any Polylude website; and
  • the time spent on those pages, items, and information searched, access times, dates and other statistics.

In certain circumstances, such as when you purchase a gift card for another individual, we may also collect other information that you provide, including:

  • your subscription tier & tax rate at the time of purchase to allow reward fulfillment.
  • optional personally identifying information, including a gift message.
  • records of what gifted funds you redeem, and when you redeem them.
  • the recipient’s name;
  • the recipient’s email address; and
  • the recipient’s postal address.

In some cases, if personal information we request is not provided, it might adversely impact our ability to supply the relevant products and/or or services to you.

Other Polylude users

To fulfill gift purchases, we may receive your contact details in order to deliver the gift.

4. How we use and disclose information that we collect about you

To operate and personalise our service

Public profile information, including biographical information you publish and your public playpens and their content, may be used as a database for public reference and searching.

We use your private playpens and their content as a database to provide for your own exploring, reference, and search.

We use information collected to verify your identity & to defend against fraud. And to comply with applicable law.

Quantify how to make our service better

We use information collected to better understand what people value or dislike about our services, so as to improve them.

Communicate with you about our services

Your information may be used to deliver updates on our services, including subscription or purchase receipts, account verification or gift codes, and changes to our terms and policies.

5. Who we may disclose your personal information to

5.1 We may disclose your personal information:

  1. as a result of change in ownership of Polylude Limited;
  2. to our service providers that we have engaged to provide a service to us in relation to the Site or any product or service that we have agreed to provide you. For example, service providers who facilitate payments and providers who host content;
  3. to courts, tribunals, and regulatory authorities; and/or
  4. to any other person or organisation that you have authorised us to disclose your information to.

We may disclose your personal information to third parties (including banks, payment gateways, credit card schemes and processors, suppliers, couriers, mailing houses and Government Authorities) in order to fulfil our services to you or as otherwise required by law. However, we require any third parties to apply standards that are no less rigorous than those required by the Privacy Act.

If we need to disclose your personal information to third parties outside of New Zealand, we will comply with our obligations under the Privacy Act in relation to offshore disclosures of personal information including, if necessary, ensuring that those third parties are subject to privacy obligations that overall provide comparable safeguards to the relevant Privacy Act.

6. Access, correction and retention of your personal information

You agree that any information you give to Polylude will be accurate, correct and up to date, and that when acting on behalf of a business or another person, you are authorised to give such information to us.

You must inform us if any of your personal information changes, to ensure that the details we hold about you are up to date and correct.

Subject to the exceptions set out in the Privacy Act, you are entitled to access the personal information we hold about you, and to request that we amend it if it is incorrect.

Different types of information are kept for different periods of time:

  • We keep your account information until you change or remove it, or for the duration of your account.
  • We keep your playpens and their contents only until you delete them, or for the duration of your account.
  • We keep your series only for as long as you hold a Premier tier (or higher) subscription.
  • Data collected during usage to provide contextual information for concepts and/or links is collected only for those recommendations and is not kept beyond providing that information.
  • Data on times of account activity shall be anonymised and kept indefinitely.

Where we no longer required your personal information, we will comply with our legal obligations in respect of that information.

6.1 Access & change

You can view, change, or download account information via your account settings.

Besides your username, which is part of your account settings, public profile information such as your display name, biography, location, and avatar, are edited directly in the app.

6.2 Deleting your information

You can follow these instructions at any time to schedule your account to be closed at the end of your current billing cycle (or immediately, if your account is presently deactivated). Upon closure, your account & profile information is deleted from our servers.

7. Security

We take reasonable steps to protect the security of personal information. We do not make any warranties in relation to the security of any information you disclose or transmit to us, and we are not responsible for the theft, destruction, or inadvertent disclosure of your personal information where our security measures have been breached.
